Industry hails the move

The Department of Health and Family Welfare proposes to introduce the Drug and Cosmetics (Amendment) Bill, 2015 in the Budget Session of the Parliament. The introduction of the bill will amend the Drugs and Cosmetics Act, 1940 for upgradation and introduction of provisions for clinical trials and regulation of medical devices.

Speaking on this issue, Bhavik Narsana, Partner, Khaitan & Co said, “It would be a welcome move to amend the Drugs and Cosmetics Act and Rules and consolidate provisions related to clinical trials and medical devices. The legislative process will invite further public discussion and debate, and also prompt meaningful legislative changes.”

“The CDSCO has clarified its intent to release a new NLEM in 2015. This is not too difficult to foresee based on the past year’s experience of the Government seeking to expand the price control regime,” said Anand Mehta, Partner, Khaitan & Co.
